Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Calibr platform, websites, assessments, scoring tools, APIs, integrations, and any related services (collectively, the "Service") operated by Calibr AB ("Calibr", "we", "us", "our"). By accessing the Service, creating an account, taking an assessment, or submitting any content, you agree to be bound by these Terms.
1. Who these Terms apply to
These Terms apply to:
- Customers - employers, recruiters, and organisations that use Calibr to assess candidates.
- Candidates - individuals who take a Calibr assessment, whether invited by a Customer or directly by Calibr.
- Visitors - anyone who browses our website or interacts with our public content.
2. The Service
Calibr provides AI-proficiency assessments and related analytics, scoring, benchmarking, and reporting tools. The Service uses artificial intelligence, machine-learning models, large language models, and third-party AI providers to design tasks, score responses, generate insights, detect patterns, and produce reports.
You acknowledge that AI-generated outputs are probabilistic, may be incomplete or imperfect, and should be used as one signal among many in any hiring or evaluation decision. Calibr does not make hiring decisions on your behalf.
3. Eligibility and accounts
- You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.
- You agree to provide accurate information and to keep it current.
- You are responsible for all activity that takes place under your account and for safeguarding your credentials.
- Customers are responsible for the conduct of their users and for ensuring candidates have been properly informed of the assessment.
4. Acceptable use
You agree not to:
- Use the Service to break any law or violate anyone's rights.
- Reverse-engineer, scrape, or attempt to extract our models, prompts, scoring logic, or training data.
- Interfere with the Service, probe it for vulnerabilities, or attempt unauthorised access.
- Submit content that is unlawful, infringing, defamatory, harassing, or deceptive.
- Use the Service to build a competing product or to benchmark against us without our written permission.
- Impersonate another person during an assessment, or knowingly allow another person to take an assessment on your behalf.
5. Your content and the rights you grant us
The Service is designed to learn, improve, and produce better outputs over time. To make that possible, you grant Calibr a broad licence to use the data and content you generate when interacting with the Service.
5.1 Definition of "Your Content"
"Your Content" means everything you submit to, generate within, or produce through the Service, including but not limited to:
- Assessment responses, written answers, code, documents, and uploaded files.
- Prompts, instructions, edits, and chat messages exchanged with AI tools inside the Service.
- Voice, audio, screen, keystroke, mouse-movement, eye-tracking (where enabled), and other interaction-level telemetry captured during an assessment.
- Metadata about your session, device, network, browser, and behaviour.
- Feedback, ratings, support tickets, and survey responses you submit to us.
5.2 Licence to Calibr
You grant Calibr a worldwide, royalty-free, sublicensable, transferable, perpetual, and irrevocable licence to host, store, reproduce, modify, adapt, translate, create derivative works of, analyse, anonymise, aggregate, and otherwise use Your Content for the following purposes:
- Operating, maintaining, and providing the Service to you and to Customers.
- Scoring assessments and generating reports, insights, and benchmarks.
- Training, fine-tuning, evaluating, and improving Calibr's own machine-learning models, scoring algorithms, prompts, and assessment designs.
- Building anonymised or aggregated datasets and benchmarks that may be shared with Customers, partners, or the public.
- Research, statistical analysis, product development, and quality assurance.
- Detecting fraud, plagiarism, candidate identity issues, and platform abuse.
- Marketing the Service, including showing anonymised excerpts as examples (we will not identify you by name in marketing without your consent).
Where Your Content is processed by third-party AI providers (for example, large-language-model APIs), it may be subject to those providers' processing terms in addition to ours. We use commercially reasonable efforts to select providers that offer enterprise-grade privacy commitments.
5.3 Ownership
You retain ownership of Your Content. The licence above is what allows Calibr to operate the Service and improve it over time; it does not transfer ownership.
6. AI training and model improvement
You expressly acknowledge and agree that Calibr may use Your Content - including assessment responses, AI-tool interactions, and behavioural telemetry - to train, fine-tune, and evaluate machine-learning models, including models that score future assessments, detect patterns, and generate benchmarks. Where required by applicable law, we will rely on a lawful basis (such as legitimate interest or your consent) and provide the controls described in our Privacy Policy.
7. Customer responsibilities
If you are a Customer, you represent and warrant that:
- You have provided candidates with all notices required under applicable law before sending them an assessment.
- You have a lawful basis to process candidate data through Calibr.
- You will not use Calibr scores as the sole basis for any decision that has legal or similarly significant effects on a candidate, and you will provide human review of automated outputs as required by applicable law.
- You will not attempt to re-identify anonymised or aggregated data made available to you.
8. Fees
Fees, billing cycles, and credits are described in your order form, contract, or on our pricing page. Unless otherwise agreed in writing, fees are non-refundable and are exclusive of taxes. We may change pricing on prospective renewals with reasonable notice.
9. Intellectual property
Calibr, the Calibr name, logo, assessments, scoring rubrics, prompts, models, dashboards, and all related software and documentation are owned by Calibr or our licensors and are protected by intellectual-property laws. Except for the limited rights granted in these Terms, we reserve all rights.
10. Third-party services
The Service may integrate with or rely on third-party services (for example, hosting, analytics, payment processors, AI/LLM providers, and ATS integrations). Those services are governed by their own terms; we are not responsible for them.
11. Confidentiality
Assessment content, scoring rubrics, prompts, and similar materials are Calibr's confidential information. You agree not to disclose them to third parties or to publish them publicly.
12. Warranties and disclaimers
The Service is provided "as is" and "as available". To the maximum extent permitted by law, Calibr disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability. We do not warrant that AI outputs will be accurate, complete, or suitable for any particular purpose.
13. Limitation of liability
To the maximum extent permitted by law, Calibr's total aggregate liability arising out of or relating to the Service or these Terms is limited to the greater of (a) the amounts paid by you to Calibr in the twelve months preceding the event giving rise to the claim, or (b) one hundred euros (EUR 100). In no event will Calibr be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, revenue, or data.
14. Indemnity
You agree to indemnify and hold Calibr harmless from any claim, loss, or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Service, or Your Content.
15. Termination
We may suspend or terminate your access at any time if you breach these Terms or if we reasonably believe continued use poses a risk to the Service or other users. You may stop using the Service at any time. Sections that by their nature should survive (including 5, 6, 9, 11, 12, 13, 14, and 17) will survive termination.
16. Changes to the Service or these Terms
We may modify the Service or these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use of the Service after changes take effect constitutes acceptance.
17. Governing law and disputes
These Terms are governed by the laws of Sweden, without regard to its conflict-of-laws principles. Disputes will be submitted to the exclusive jurisdiction of the courts of Stockholm, Sweden, unless mandatory consumer-protection law provides otherwise.
